Every eligible subscriber has a personal referral link and chooses one of two mutually exclusive reward modes in their account: (a) Free-subscription mode — your own subscription is free for any billing period during which you have 3 or more active, paying, non-refunded referred subscribers on plans of equal or greater value than your own plan; or (b) Affiliate mode — you pay for your own subscription and earn cash commissions under these Terms. You may switch modes in your account at any time; a switch applies going forward only. While you are in free-subscription mode you accrue no commissions, and while you are in affiliate mode your subscription is not free — the two benefits never stack.
In affiliate mode you earn 30% of each payment we actually receive from each subscription that signed up through your referral link, for as long as both (a) that referred subscription remains active and paying, and (b) your own subscription remains active and in good standing. If your own subscription lapses, is canceled, or is revoked, commission accrual stops until it is active again; payments received during a lapse do not accrue commission retroactively. Commissions are calculated on the amount we receive net of taxes the customer pays; promotional or discounted payments accrue 30% of the discounted amount actually received.
This is a single-tier program. You earn only on subscribers who joined directly through your link. There are no commissions on referrals made by your referrals, no downlines, no recruitment rewards, and no payment for recruiting other affiliates. Any attempt to operate the program as a multi-level structure is a violation of these Terms.
Each commission is credited with status "held" for 30 days from the underlying payment, to cover the refund window. After the hold period it becomes "available" for cash-out.
If a payment that generated a commission is refunded, disputed, or charged back — in whole or in part — the corresponding commission is clawed back. If the commission was still held, it is canceled; if it had already become available (or was paid out), a negative adjustment is applied to your balance, and we may offset it against future commissions or require repayment. Your balance always reflects payments we actually kept.
The minimum cash-out is $25.00 of available balance. You cash out on demand from your account page; each cash-out transfers your entire available balance through Stripe, our payment processor, to the payout account you connect via Stripe's hosted onboarding (Stripe collects and stores your identity and bank details — we never see them). Cash-outs above $10,000 in a single transaction are held for manual review as a fraud-protection measure and then paid. You are responsible for providing accurate payout and tax information (including a Form W-9 or W-8 where required — we may withhold payouts until we have it, and Stripe may require identity verification before enabling payouts) and for any taxes on your commissions. You are an independent contractor, not an employee, agent, or partner of ViticusX LLC.
Commissions are taxable income to you, whether or not any tax form is issued. You are an independent contractor, and nothing is withheld from your payouts. If we pay you $2,000 or more in a calendar year, we report that total to the IRS and furnish you a Form 1099 by January 31 of the following year; that $2,000 figure is the federal threshold for payments made during 2026 and is subject to change (it was $600 for payments made before 2026, and is inflation-adjusted for years after 2026). Below that threshold no form is issued, but the income remains reportable by you. Your state may require reporting at a lower amount. Stripe collects the taxpayer information used for this reporting (legal name and SSN or EIN) during payout onboarding; if that information is missing or incorrect we may hold payouts until it is supplied, and backup withholding may be required by law. Self-employment tax may also apply to your net earnings. None of this is tax advice — consult a tax professional about your own situation.
You must clearly disclose that you earn money from your link whenever you share it — e.g. "I earn a commission if you sign up with my link" (or in Spanish, "Gano una comisión si te inscribes con mi enlace") — placed where readers will see it before clicking, as required by the U.S. FTC's endorsement guides. You may not make false or unsubstantiated claims about the course (including any claim that it guarantees passing an exam or inspection), may not pose as an ordinary customer while earning commissions, and may not spam. You are responsible for your promotional conduct complying with applicable law.
Self-referrals, referring the same household/payment method to farm credit, fake or stolen payment methods, cookie stuffing, misleading advertising, bidding on our trademarks, incentivizing sign-ups you subsidize in order to harvest commissions, and any scheme to game the ledger are prohibited. Violations void the affected commissions, may forfeit your entire accrued balance, and may result in account closure under the Terms of Service, after investigation.
We may modify, suspend, or terminate the affiliate program — including the commission rate, hold period, and minimum cash-out — with notice (posted here and/or emailed), effective for payments received after the notice period. Commissions already accrued under the prior terms remain governed by them, subject to Sections 5 and 9. If the program is terminated, valid available balances above $0 will be paid out even if below the minimum.
Individuals referring fleets. If a fleet (a business buying seats for its drivers) signs up through your referral link, in affiliate mode you earn 10% of the seat revenue we actually receive from that fleet during its first 12 months as a customer — for example, a 30-truck fleet works out to roughly $95 per month, about $1,150 over the year. Everything else in these Terms applies to fleet commissions exactly as it does to driver commissions: the 30-day hold (Section 4), refund and chargeback clawbacks (Section 5), the $25.00 minimum cash-out (Section 6), the requirement that your own subscription remain active and in good standing (Section 2), and the single-tier rule (Section 3). After the referred fleet's twelfth month as a customer, no further commissions accrue on that fleet.
Businesses referring businesses. When a fleet refers another fleet, the referring fleet receives seat credits, never cash: free seats equal to 10% of the referred fleet's paid seat count, applied for 12 months while both fleets remain active, paying customers. Seat credits have no cash value, are not transferable, and cannot be converted into a payout.
Industry partners. Trucking schools, insurers, associations, and similar industry partners may qualify for a separate partner tier (typically 15–20% of first-year revenue) by individually negotiated written agreement only; those arrangements are governed by their own agreement, not by this Section.
Timing. Fleet referrals are live. A fleet is credited to your link when it creates its account through that link; cash commissions accrue on each seat-bill payment we receive during the referred fleet's first 12 months as a paying customer, and are held, clawed back, and paid out under Sections 4, 5, and 6 exactly like driver commissions. Fleet-to-fleet seat credits are applied to the referring fleet's account and recalculated as the referred fleet's paid seat count changes; they end when either fleet stops being an active paying customer, or after 12 months, whichever comes first.
These Affiliate Program Terms supplement the Terms of Service, which are incorporated by reference — including the disclaimers, limitation of liability, and the dispute terms: Florida law governs, and disputes are resolved by binding individual arbitration in Florida under American Arbitration Association rules, with class actions and jury trials waived. If these Terms conflict with the Terms of Service on an affiliate-program topic, these Terms control.
